Highworth Diversion Order 2013
On the 13 March 2013 Swindon Borough Council confirmed the above order made under section 119 of the Highways Act 1980.
The effect of the order as confirmed is to divert a length of Footpath No 9A, in the Parish of Highworth, running from OS Grid Reference SU 42031921, at the entrance to the school grounds between 19 and 20a Kings Avenue, leading in a south easterly direction for approximately 300 metres to OS Grid Reference SU 42041928 at the southern boundary of the school grounds. The new line of the footpath will run from OS Grid Reference SU 42031921 at the entrance to the school grounds between 19 and 20a Kings Avenue, leading generally in an easterly direction for approximately 62 metres and then turning south easterly, running parallel with the school boundary fence, for approximately 239 metres and then turning south westerly for approximately 80 metres to join Footpath 9A Highworth at OS Grid Reference SU 42041928 on the southern boundary of the school grounds as shown on the order map, having a definitive width of 2.0 metres.
A copy of the order as confirmed and the order map may be seen free of charge at the One Stop Shop, Wat Tyler House, Beckhampton Street, Swindon from 9.00am to 4.30pm on Mondays to Fridays. Copies of the order and map, costing £15.00, may be purchased there.
The order comes into force on 13 March 2013 but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the grounds that it is not within the powers of the Highways Act 1980, as amended, or on the grounds that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 21 March 2013 make an application to the High Court.
