Planning and Compulsory Purchase Act 2004
In accordance with Regulation 16 and Regulation 19 of the Town and Country Planning (Local Development) (England) (Amendment) Regulations 2004 as amended by Regulation 11A of the Town and Country Planning (Local Development) (England) (Amendment) Regulations 2008, as amended by Regulation 2 the Town and Country Planning (Local Development) (England) (Amendment) Regulations 2009 notice is hereby given that Swindon Borough Council formally adopted the ‘Inclusive Design Access for All’ Supplementary Planning Document on 19th April 2011 and the ‘Residential Extensions and Alterations’ Supplementary Planning Document (SPD) on 11th October 2011.
The ‘Inclusive Design Access for All’ SPD forms part of the Local Development Framework (LDF) and has been prepared to provide detailed guidance to assist in achieving high quality and inclusive design for all development, including buildings, public and private spaces. The SPD will be taken into account as a material consideration in the determination of planning applications.
The ‘Residential Extensions and Alterations’ SPD also forms part of the Local Development Framework (LDF) and has been prepared to provide detailed guidance to assist in achieving high quality development and protect amenity. The SPD will be taken into account as a material consideration in the determination of ‘householder’ planning applications.
These Supplementary Planning Documents have been subject to a detailed, comprehensive process of Sustainability Appraisal, incorporating a Strategic Environmental Assessment, from the outset.
This was closely integrated with preparation of both SPD’s at each stage, and subject to wide-ranging stakeholder consultation.
Any person aggrieved by the ‘Inclusive Design Access for All’ SPD or the ‘Residential Extensions and Alterations’ SPD may make an application to the High Court under Section 113 of the Planning and Compulsory Purchase Act 2004, on the grounds that the document is not within the appropriate power or that a procedural requirement has not been complied with. Any applications must be made no later than eight weeks from 3rd November 2011.
Copies of the adopted SPDs and associated documentation are available for public inspection at Swindon Borough Council Customer Services in Wat Tyler House, Beckhampton Street, Swindon, SN1 2JH, and the Borough’s website at: http://www.swindon.gov.uk/design These documents will also be available to view at all libraries within Swindon Borough.
