Notice of Confirmation of Rail Crossing Diversion Order

Footpath 285 Swindon and 59 Wroughton

On 9 March 2012, the Secretary of State for Environment, Food and Rural Affairs confirmed with modifications the above order made under section 119A of the Highways Act 1980 (as amended by the Transport and Works Act 1992).

The effect of the order as confirmed is to divert the full length of Footpath No 285 Swindon and a length of Footpath 59 in the Parish of Wroughton, as shown on the order map by a bold continuous line running from Grid Reference SU 112829 at the junction with Frankland Road, side of MAN ERF UK Ltd, leading in a southerly, south easterly and generally north easterly direction for approximately 510 metres to the Wroughton Parish boundary at Grid Reference SU 11428266 and then in a south easterly direction within the Parish of Wroughton for approximately 30 metres to Grid Reference SU 11438264. The new route of the footpath will be as shown on the order map by a broken line from Grid Reference SU 11438264 south of the railway line approximately 30 metres north of the M4 Motorway leading in a north easterly direction for approximately 796 metres and then turning north north easterly for approximately 90 metres to join Footpath 41 Wroughton at Grid Ref SU 122830, having a definitive width of 2.0 metres.

A copy of the order and the order maps may be inspected at The One Stop Shop, Beckhampton Street, Swindon from 8.30am to 6pm Mondays to Fridays. Copies of the order and map, costing £15.00, may be purchased there.

The order comes into force on the date on which Swindon Borough Council certify that the terms of Article 1 have been complied with, but if any person aggrieved by the order desires to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act as amended, or of any regulation made under it has not been complied with in relation to the order, he or she may under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 26 March 2012, make an application to the High Court.
