In the dock: Latest cases from Swindon Magistrates' Court

SWINDON: Kris Patrick George Cooper has been given a community order after he admitted damaging a car. The 38-year-old, of no fixed abode, damaged the 2012-plate Suzuki Splash, and intending to destroy or damage it or was reckless as to whether it would be destroyed or damage. He pleaded guilty to one count of criminal damage at a previous hearing. Cooper was given a one-year community order, during which he must complete 15 rehabilitation activity days. He must also pay a £114 victim surcharge.

TOWN CENTRE: Marcin Piotr Milczarek has been given a suspended sentence after he was caught drink driving whilst banned. The 44-year-old, of Groundwell Road, was behind the wheel of a BMW 530 on Groundwell Road on September 2 when he had 94 micrograms of alcohol per 100 millilitres of breath – more than double the drink drive limit. He was also banned from driving at the time. Magistrates deemed that the offence was so serious a suspended sentence was necessary, because it was so soon after the initial disqualification and that Milczarek had shown a “wilful disregard for court orders”. He was given a 12-week prison sentence, suspended for two years. During that time, he must complete 20 rehabilitation activity days and 200 hours of unpaid work. Milczarek must also pay a £154 victim surcharge, £85 in costs, and will be subject to a three year driving ban.

PEATMOOR: Frankie Mazzotta has been banned from driving after he admitted a host of offences including drug driving. The 35-year-old, of Letterage Road, admitted being under the influence of cocaine and benzoylecgonine, a breakdown product of the Class A drug. When police stopped his silver Audi Q5 on March 24, there was 32 micrograms of cocaine in his system, over the drug-drive limit of ten, and 793 micrograms of BZE, over the limit of 50. He was also found in possession of cannabis, and driving without insurance. Mazzotta was fined £350, banned from the roads for 16 months and the drugs were forfeited and destroyed. He must pay £85 in costs and a £35 victim surcharge.

SWINDON: George Saunders has been banned from the roads after he drove whilst more than ten-times the drug drive limit for ketamine. The 29-year-old, of Morecombe Way in Fairford, was found behind the wheel of a BMW 118d on Bridge End Road in Swindon on March 24 whilst under the influence of ketamine, cocaine and benzoylecgonine, a breakdown product of cocaine. After giving a blood sample, it was found there was more than 200 micrograms per litre of blood, more than ten times the limit. He was also found to have 664 micrograms of BZE, over the limit of 50, and 32 micrograms of cocaine in his system, over the limit of ten. Saunders further pleaded guilty to possession of cocaine. He was banned from the roads for two years and fined £400. Meanwhile, the drugs were forfeited and destroyed, whilst he will have to pay costs of £85 and a £30 victim surcharge.

HAYDON WICK: Tomas Akstinas has been banned from the roads after he drove whilst disqualified and without insurance. The 35-year-old, of Clary Road, admitted driving a Honda CRV on Elstree Way on March 25 whilst banned and without insurance. In the hearing at Swindon Magistrates’ Court on September 28, a third charge of aggravated vehicle taking was withdrawn. The charge had alleged that Akstinas had taken the vehicle without consent, and that owing to the driving of the vehicle, damage was caused to a 2017-plate Volkswagen Passat. Akstinas was given a one-year community order, during which he must complete 70 hours of unpaid work. He was also given a three-month ban from driving, and ordered to pay a £40 fine. Meanwhile, the defendant must also pay £85 in costs and a £95 victim surcharge.
