A Wiltshire man who refused to do a breath test due to his 'illnesses' has now been banned from the roads for being four times over the legal limit.

Ross Philip George Miflin, 27, of Maud Heaths Causeway in Kellaways, near Chippenham, was stopped by police officers on Hill Corner Road on July 28, 2024.

Police officers stopped the blue Subaru Impreza just before midday and noted how the man "smelled of alcohol, couldn't stand still and admitted he had been drinking the night before."

Miflin was found to have 152ug of alcohol in 100ml in his breath when completing a roadside breath test.

The legal limit is 35ug per 100ml.

But when he was taken to the police station in Melksham, the 27-year-old refused to provide any more breath samples, first claiming that he had Covid-19 and then later stating that he had lung cancer.

Appearing before Salisbury Magistrate's Court on August 13, Miflin has now been banned from the roads for four years, and ordered to complete 200 hours of unpaid work.

The defendant made it clear in court that he had failed to provide a second sample to try and receive a lesser sentence at court.

“This was a serious offence for which Miflin faced the possibility of prison as a result," said PC Mark Higgs, from Wiltshire's Road Policing Unit.

“We will not tolerate drink driving and this case shows that trying to buck the system doesn’t work.”
