A man was knocked out in what has been described as a "horrible attack" outside a Wetherspoons pub when he was with his mother.

The victim received fractures to his skull from the knock-out blow before Tyrrell Gresty kicked him in the ribs outside the Sir Daniel’s Arms pub.

Gresty, a Swindon 20-year-old, pleaded guilty to actual bodily harm at Swindon Magistrates’ Court on November 19.

A second defendant accused of the original punch was charged with section 18 grievous bodily harm - the most serious form of assault. 

He appeared at Swindon Magistrates’ Court the next day. He did not plea and cannot be named for legal reasons.

Abbie Winters, prosecuting, said “[the victim] has been seriously assaulted by Mr Grestry and [his co-defendant]”, starting outside the Sir Dan’s Arms Wetherspoons and ending outside The Waiting Room pub on Fleet Street.

She explained: “There was an incident earlier in the evening where two groups had squared up to each other, but there's been no punches, no injuries. 

“It's later on in the evening that [the victim] is out with his mother, who has received inappropriate sexual behaviour by some other individuals.”

The two defendants got involved and Gresty pushed the victim, who in turn tried to punch Gresty but missed.

“[The co-defendant] has then punched [the victim] to the face… and completely knocked him unconscious - he flails and flies to the floor.

“He is clearly unconscious, facing Gresty, who has with some force, lifted his leg back and kicked him in the ribs.”

The punch led to a “huge list” of injuries, said Ms Winters, including hearing loss and fractures in his face, but Gresty’s kick did not give any clear injuries.

Ms Cole, defending Gresty, argued he did not know the victim was unconscious when he kicked him, but did it as soon as he hit the floor.

However, district judge Joanna Dickens said: “It's quite obvious when you look at it that he's kicking someone on the ground.

"It may have been an instantaneous decision, but the man was on the ground.”

She called it a “horrible incident” and argued it was a more harmful attack than even the prosecution claimed, sending it to the Crown Court.

Gresty will be sentenced at Swindon Crown Court on January 3, 2025, while his co-defendant will plea there on December 20, 2024.

Gresty was released on conditional bail to not contact the victim or his mother, and the co-defendant must also not enter a town centre area from 6pm to 6am.
